Instant Triple Talaq will soon be a non-bailable offence


On Friday, 15/12/2017, on the first day of the Winter Session of parliament, the Union Cabinet cleared the Muslim Women Bill (Protection of Rights on Marriage), 2017, which makes the practice of instant Triple Talaq a non-bailable offence. The bill proposes a 3 year jail term for erring men.

 

Under the proposed bill, triple talaq in any form- spoken, written or by electronic means such as SMS, Whats App messages or emails – would be illegal. Triple talaq or Talaq-e-biddat will be a “cognizable and non-bailable” offence.  As per the draft, the wife will be entitled to maintenance and the custody of children if they are minor.

The issue of banning instant triple talaq was the part of the BJP’s political campaign in the Uttar Pradesh elections and the BJP government is looking determined on delivering on this promise to Muslim women.
